Dismissal with prejudice was obtained pursuant to plaintiff's failure to exhibit diligence in service against homeowner. 

Dismissal with prejudice was also obtained based upon finding that the four-year construction statute of limitations was inapplicable to homeowner who was uninvolved with the construction of her home's pool deck area where the alleged slip and fall occurred.
