Overview

We provide coverage opinions and also have specific expertise in the law, statutes, and regulations regarding tenders of defense and indemnity under commercial general liability and automobile insurance policies.  We have extensive experience regarding additional insured status, as well as the interplay between multiple primary and excess coverage on behalf of insureds and the insurers.

We prosecute and defend declaratory judgment actions.  We also defend insurance companies against claims of bad faith and breach of contract.

Representative matters

Coats v. Cincinnati

Cook County, Illinois

Defended insurer in litigated uninsured motorist claim with allegations of bad faith regarding left-turning uninsured motorist as the result of which plaintiff claimed low back injury and medical bills in excess of $200,000, plus lost income claim.  Case settled for less than half of claimed special damages.

Insurance Broker Liability

Cook County, Illinois

Prosecuted professional negligence against insurance broker for failure to procure insurance coverage for construction general contractor.  Settlement subject to confidentiality agreement.

Pekin v. Tovar

Cook County, Illinois

Obtained declaratory judgment that insurance carrier for snow removal subcontractor owned defense obligation to upstream snow removal contractor.  Affirmed on appeal.

Insured Counselling

Cook County, Illinois

Counseled property manager for residential condominium complex with respect to obligations of insurer for complex owner regarding additional insured obligations in connection with fall-down suit.

Spahr

Cook County, Illinois

Defended underinsured motorist claim in connection with loss of control by underinsured vehicle operator which resulted in commercial driver also losing control and striking highway median.  Plaintiff required emergency tracheotomy, insertion of feeding tube, and extensive facial reconstruction.

Counselled insured scrap metal intermediary as to insurance obligations of carrier for trucking company, regarding effect of omnibus provision with respect to vicarious liability allegations in wrongful death action.

Counselled insured asset recovery contractor regarding insurance obligations of carrier for downstream vehicle repossession contractor regarding additional insured obligations, effect of omnibus provision, and right to independent counsel.

Counselled property manager and condominium association in connection with fall down at commercial office complex regarding additional insured obligations of insurer for snow removal contractor with respect to defense, indemnity, and right to independent counsel.

Cook County, Illinois

Counselled insurer regarding denial of coverage to national retailer, in connection with fall down, based on unjustifiable delay.

Cincinnati Insurance Company v. Robert Pritchett

Will County, Illinois

Filed declaratory judgment action alleging that the defendant is not entitled to uninsured motorist coverage as a result of a single motor-vehicle accident.  The defendant alleges that the policy language is ambiguous and should be interpreted as providing for coverage in the absence of physical contact between the insured vehicle and a hit-and-run vehicle.  Case is pending.

Pacific v. Cincinnati Insurance Companies

Cook County, Illinois

Represented commercial lines carrier in declaratory judgment action addressing priority of selected excess coverage and deselected primary coverage, as an issue of first impression in Illinois.
